Step 1: Figure out how the inherited house passes to you

How the title moves decides when you can sell. The common paths in Wisconsin:

  • Joint tenancy or a transfer-on-death deed. The house may pass outside probate. The survivor or beneficiary usually records paperwork with the Milwaukee County Register of Deeds and can then sell.
  • Small estate (Transfer by Affidavit). If the property subject to administration in Wisconsin is $50,000 or less in gross value, heirs can use a Transfer by Affidavit (Wis. Stat. 867.03). For real estate, the affidavit is recorded with the register of deeds in the county where the house sits, after giving the other heirs at least 30 days' notice. Recording the affidavit is what transfers the house.
  • Probate. Most Milwaukee houses are worth more than $50,000 (the city's median sale price was $244,838 for the three months ending August 2026, per Redfin), so most inherited homes go through probate.

Step 2: Probate in Milwaukee County, in plain terms

Probate for Milwaukee County residents runs through the Milwaukee County Circuit Court, Probate Division, at the courthouse at 901 N. 9th St., Room 207. Wisconsin offers two routes:

  • Informal administration is supervised by the Probate Registrar and can be done without an attorney.
  • Formal administration goes before a judge and requires an attorney. An estate can be moved to formal administration if, for example, the will is contested.

Plan on time. Published guides for Milwaukee County estimate 6 to 12 months for simple informal estates and 9 to 15 months for an average one. The court's filing fee is generally 0.2% of the estate's net value for estates over $10,000.

The important part for selling: once the court issues letters, the personal representative may sell estate property "without notice, hearing or court order" (Wis. Stat. 860.01). You don't have to wait for the whole estate to close to list the house. I always recommend confirming the details with the estate's attorney or the Register in Probate, because every estate is a little different and I'm not a lawyer.

Step 3: Know the Milwaukee rules that catch heirs off guard

Vacant building registration

The City of Milwaukee requires a vacant building to be registered within 30 days of it becoming vacant, and the Department of Neighborhood Services inspects it at registration and every 6-month renewal. The first 6 months are free; renewals cost $253.50. There is an exemption for estate properties in probate when the personal representative or executor lives in the 7-county area. Listing the house "for sale" does not exempt it. If you live out of state, this one matters (City of Milwaukee DNS).

Open code orders

Buyers and title companies often run a DNS Title Search ($50.80) to see open code violations and special charges. The new owner becomes responsible for unabated violations, so open orders on an older house can shrink your buyer pool or show up in negotiations.

Disclosures

Wisconsin sellers normally give buyers a Real Estate Condition Report. Personal representatives, trustees and conservators are exempt if they never occupied the property (Wis. Stat. 709.01(2)). If you are selling as an heir who already holds title, that exemption may not apply to you. Ask your attorney which situation you are in.

  • Wisconsin has no inheritance tax for deaths on or after January 1, 1992, and no estate tax for deaths after December 31, 2007 (Wisconsin Department of Revenue).
