How to Sell an Inherited House in Madison, WI (2026 Dane County Guide)

by Kyle Ristow

Wisconsin State Capitol grounds in Madison, WI, where Luxe Haven Real Estate Group helps families sell an inherited house in Madison

Short answer: You can sell an inherited house in Madison, but who can sign depends on probate. If the home was in the decedent's name alone, the personal representative the Dane County Register in Probate appoints usually signs the listing or the cash-offer contract. Once that authority is in place, you can list it, sell it as-is for cash, or keep it, and Wisconsin has no inheritance or estate tax on a death today.

I'm Kyle Ristow with Luxe Haven Real Estate Group. Families call me after a parent, grandparent or relative passes and the house is sitting there with taxes, utilities and questions piling up. This guide walks through the Madison and Dane County steps in plain English. I'm a Realtor, not an attorney, so use it to ask better questions, and lean on a Wisconsin probate attorney for legal advice.

Do you need probate to sell an inherited house in Madison?

Often, yes. The Dane County court's own probate brochure says probate is generally needed when the decedent owned more than $50,000 in assets in their name alone, or was the sole owner or a tenant in common of real estate. A home that passes through a living trust, joint tenancy with survivorship or a payable-on-death designation can skip probate, so check how title is held before you assume probate is needed.

In Dane County, probate is filed with the Register in Probate at the Dane County Courthouse, Room 1005, 215 South Hamilton Street, Madison. The office lists (608) 266-4331 and encourages appointments. For an estate over $10,000, the statutory inventory filing fee is 0.2% of the property subject to administration, less liens and encumbrances.

Informal probate, formal probate and the small-estate shortcuts

The Dane County brochure calls informal administration the most common route. It generally works when there is a valid will that does not prohibit it, or when there is no will and all interested persons agree. Formal administration is a court proceeding and requires an attorney. It is used when the will requires it or when heirs disagree.

Wisconsin also has shortcuts for small estates. Transfer by affidavit under Wis. Stat. 867.03 applies only when the property has a gross value of $50,000 or less, and the statute adds notice rules for real estate. Most Madison homes are worth far more than that, which is why a house usually points to full probate. Ask your attorney which path fits your family.

Who can sign the listing or the cash-offer contract?

When a house goes through probate, heirs do not each sign on their own. Once the court issues letters, the personal representative has the authority to sign the listing agreement and the purchase contract for the estate. Title companies typically ask to see that paperwork before closing, so get it early.

One Wisconsin detail helps estates: under Wis. Stat. 709.01(2), personal representatives, trustees, conservators and court-appointed fiduciaries who have never occupied the property are exempt from the real estate condition report requirement. That does not mean problems can be hidden, so ask your attorney what you still need to disclose.

What is an inherited house worth in Madison right now?

Redfin reports the City of Madison median sale price was $439,791 in September 2026, up 4.7% from a year earlier, with a median of 50 days on market and homes selling at about 100.1% of list price. Mad City Dream Homes, using South Central Wisconsin MLS data, reported a $537,300 median for Madison-area single-family homes in June 2026 and about 1.8 months of supply. Your house will land somewhere on that range depending on condition, block and size, so get a street-level number instead of a citywide guess. Three ways to sell an inherited house in Madison

1. List it on the MLS

If the house is in good shape and the family can wait for the process, listing usually gets the highest price. Clever's 2026 survey puts the average total real estate commission in Madison at 5.61%, and Opendoor estimates total seller costs of roughly 6% to 8%. Wisconsin's transfer fee is $3 per $1,000 of value under Wis. Stat. 77.22. I walk estates through those numbers up front. For a line-by-line example, see my inherited house guide for Milwaukee, which uses the same Wisconsin rules.

2. Sell it as-is for cash

If the house needs work, is full of belongings, or the heirs live out of state, a direct as-is cash offer skips repairs, showings and cleanout. You choose the closing date, and the personal representative still signs. Cash buyers normally pay less than a fully prepared listing would bring, so compare both before you decide. You can request a no-obligation cash offer and see the number next to a listing estimate.

3. Keep it or rent it

Some heirs keep the house as a rental. If it has tenants, read my guide to selling a house with tenants in Madison before you decide either way.

Taxes and carrying costs to plan for

The Wisconsin Department of Revenue states there is no estate tax for decedents dying after December 31, 2007, and no inheritance tax for deaths on or after January 1, 1992. On the federal side, the IRS says the tax basis of inherited property is generally its fair market value on the date of death, so a sale close to that value often produces little taxable gain. A tax professional should confirm your situation.

Property taxes keep coming. Dane County's first installment is due January 31 and the final installment July 31, with late payments charged 1.5% per month starting February 1. City of Madison properties are collected by the City Treasurer, (608) 266-4771. Look up the parcel on Access Dane, and budget for insurance, utilities and lawn or snow care while the estate settles.

Frequently asked questions about selling an inherited house in Madison

Do I have to finish probate before I list an inherited house in Madison?

You usually need legal authority to sell first, meaning the personal representative's letters from the court. The house can often be prepared and priced while probate is in progress, and a purchase contract can be written with a closing date that fits the court timeline.

Who pays the costs of an inherited house while the estate is open?

The estate pays them, usually from estate funds, and the personal representative keeps records. Property taxes, insurance, utilities and basic upkeep add up, which is one reason many Madison families choose a faster sale.

Do I owe tax when I sell an inherited house in Wisconsin?

Wisconsin has no inheritance or estate tax for current deaths. You may owe capital gains tax only on appreciation above the home's value on the date of death, per the IRS basis rule. Confirm with a tax professional.

Can I sell an inherited house as-is in Madison?

Yes. Estates sell houses as-is all the time, either to a cash buyer or as a listing with no repairs. A condition report exemption may apply under Wis. Stat. 709.01(2), but ask your attorney what you must still disclose.

How long does it take to sell an inherited house in Madison?

It depends on the probate path. Dane County's brochure says a summary settlement can take a day or two and a summary assignment at least four to six weeks, while a typical Madison listing took a median of 50 days on market in September 2026 (Redfin).
