How to Sell a House With Tenants in Milwaukee, WI (2026 Guide)

by Kyle Ristow

Short answer: You can sell a house with tenants in Milwaukee, WI without waiting for the lease to end. In Wisconsin a sale does not cancel a lease, so the buyer takes the property subject to the tenant's rights. Your three options are to sell it occupied, to sell it vacant after the lease ends, or to take a direct as-is cash offer. The right one depends on your lease dates, your timeline and what the numbers look like side by side.

I'm Kyle Ristow, and with the Luxe Haven Real Estate Group team I help Milwaukee owners sell homes that come with a lease attached. This guide covers how to sell a house with tenants in Milwaukee: what Wisconsin law says, what the City of Milwaukee asks of owners, and how to choose between listing and a cash sale.

Why Selling a Rented House in Milwaukee Is Different

Rentals are a big part of the city's housing. The Census Bureau lists an owner-occupied housing unit rate of 41.8% for the City of Milwaukee (2020-2024), which means just over 58% of occupied homes are rented, and the median gross rent is $1,059 (Census QuickFacts). Rentals here run from single-family houses to duplexes and small multi-unit buildings, and each one raises the same question at sale time: what happens to the people living there?

What Wisconsin Law Says When You Sell With Tenants in Place

The lease stays in force. The Wisconsin REALTORS® Association explains that the sale of a property does not terminate a lease or rental agreement, and that a buyer takes title subject to the tenant's rights (WRA Legal Hotline). Wis. Stat. 704.09 supports that: a landlord's interest can generally be transferred, and lease covenants are enforceable by or against successors (704.09).

Month-to-month tenants. Ending a periodic tenancy takes at least 28 days' notice, and it can end only at the end of a rental period (Wis. Stat. 704.19).

Showings. A landlord may show the premises to purchasers on advance notice and at reasonable times (704.05(2)). Under ATCP 134.09, advance notice means at least 12 hours unless the tenant agrees to less (ATCP 134.09).

Possession and deposits. The standard WB-11 offer gives the buyer occupancy at closing, subject to the tenant's rights, and the buyer must honor the tenant's deposit rights. How the deposit changes hands at closing should be written into the offer, and your attorney should confirm it (WRA).

Milwaukee Checks Before You List a Rental

Property registration. The City of Milwaukee requires owners of non-owner-occupied residential property to register their ownership contact information. The fee is $101.60 per tax key when filed within 15 days of a title transfer and $177.80 when filed 16 days or more after, plus a 1.6% surcharge (City of Milwaukee Property Registration). The city also has a Seller Notification Form (DNS-8D) to report a change of ownership, so call Property Registration at (414) 286-8569 to confirm what applies to your sale.

Vacant buildings. If your tenants move out and the building sits empty, owners of residential property left vacant for 30 days or more must register it with the Department of Neighborhood Services (DNS). A buyer who acquires a vacant building must register it within 30 days of the sale, and the seller must tell that buyer about the requirement (DNS vacant building FAQ). If you plan to sell vacant, line up your closing date before the 30 days run out.

Lead paint. For most pre-1978 housing, sellers and landlords must give buyers and renters the EPA lead pamphlet, disclose known lead hazards, include a lead warning statement, and allow a 10-day window for a paint inspection unless the buyer waives it (EPA).

Condition report. Wis. Stat. 709.01(2) exempts only fiduciaries, such as personal representatives and trustees, who never occupied the property, so most landlords complete the Real Estate Condition Report like any other seller (709.01). Answer "unknown" only where that is true, and ask your attorney if you are unsure. If the building has open city orders, my guide on selling a house with code violations in Milwaukee explains how those are handled.

Three Ways to Sell a House With Tenants in Milwaukee

1. Sell it occupied

Rent keeps coming in until closing, and you avoid a vacancy. Expect buyers to ask for the lease, the rent amounts, the deposit held and who pays which utilities, so gather those first. Because the tenant stays, the pool of buyers tends to lean toward people who want an income property, and the offer should say clearly which lease terms the buyer is taking on.

2. Sell it vacant after the lease ends

Waiting until the lease ends lets buyers who want to move in bid, but the building has to stay in shape and you carry it while it is empty. Watch the 28-day notice rule for month-to-month tenants, the 30-day vacant building registration and your showing notices.

3. Take a direct as-is cash offer

Luxe Haven Real Estate Group can make a direct cash offer with no repairs, no showings and a closing date you pick (see our cash offer page). We show the cash number next to what the home could bring on the open market, so you choose with real numbers instead of a guess.

What You Pay and What You Keep

Wisconsin's real estate transfer fee is 30 cents per $100 of value, which works out to $3 per $1,000 (Wis. Stat. 77.22). On a $240,000 sale that is $720. Rental sales add tax questions a primary-home sale does not: the IRS says unrecaptured section 1250 gain from selling real property is taxed at a maximum 25% rate (IRS Topic 409), and real property held as an investment can qualify for a like-kind exchange (IRS). Frequently Asked Questions

Can I sell my house while tenants are living in it?

Yes. A sale does not terminate a lease in Wisconsin, so you can list it or sell it to a cash buyer with the tenants in place. The buyer takes the property subject to the tenant's rights.

Does the lease end when I sell a rental property in Milwaukee?

No. The lease continues with the new owner. A month-to-month tenancy can be ended only with at least 28 days' notice, effective at the end of a rental period, under Wis. Stat. 704.19.

How much notice must I give tenants to show the house?

Wisconsin allows showings to prospective purchasers on advance notice at reasonable times, and ATCP 134.09 defines advance notice as at least 12 hours unless the tenant agrees to less.

Do I have to tell the City of Milwaukee when I sell a rental?

The city requires non-owner-occupied residential owners to register, and it has a Seller Notification Form (DNS-8D) for ownership changes. Call Property Registration at (414) 286-8569 to confirm what applies to your sale.

What happens to the tenant's security deposit when I sell?

The buyer must honor the tenant's deposit rights. Spell out in the offer how the deposit is transferred or credited at closing, and have your attorney review it.

Should I sell occupied or wait for the lease to end?

It depends on the lease end date, your carrying costs and the price gap between the two paths. I can put an occupied sale, a vacant sale and a cash offer side by side so you can compare.
